These Terms of Use (“Terms”) govern your use of imperfection.design (the “Site”), operated by Design Ventures LLC, a New Jersey limited liability company doing business as ImPERFECTION DESIGN, Architectural Interiors (“we,” “us”). By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

We provide interior design services. We are not licensed architects or engineers and do not provide architectural, structural or engineering services, which require licensed professionals. The word “Architectural” in our brand describes our design focus and does not indicate licensure or regulated architectural services. Please consult licensed professionals for structural, building code or technical matters.

Project examples, images, renderings, videos, tours and any costs shown on the Site are illustrative and for presentation purposes only. They are not offers or guarantees of price or outcome. Each project is governed by its own written agreement, which prevails over these Terms.

Some services are performed by independent contractors under separate agreements. Our Privacy Policy and Cookie Policy explain how we handle personal information. These Terms are governed by the laws of the State of New Jersey.

1. Introduction

These Terms apply to the Site and any transactions related to our interior design concepts and services. Additional agreements (e.g., for specific projects) may supplement these Terms and will prevail in case of conflict.

2. Binding Agreement

By using the Site, you agree to these Terms. We may require explicit acceptance in certain cases.

3. Electronic Communications

Communications via the Site or email satisfy legal requirements for written notices.

4. Intellectual Property

We own all copyrights, trademarks, and other IP on the Site. You may not copy, reproduce, or commercialize content without permission, except as allowed by law. All media and content are for marketing purposes only and remain our property or that of our subcontractors.

5. Fee Calculator, Newsletter and Emails

Estimates from our fee calculator are indicative and are not an offer or a binding price. Your fixed fee is confirmed only in a written proposal. When you submit your email address through the Site, including the fee calculator, you agree to receive emails from us about your request and our services, including follow-ups, design ideas, news and offers. You can unsubscribe at any time using the link in any marketing email or by writing to privacy@imperfection.design. You may forward our newsletter electronically. Our Privacy Policy explains how we use your information.

6. Third-Party Links

We are not responsible for third-party sites linked from ours. Use them at your own risk.

7. Responsible Use

Use the Site only for lawful purposes. Prohibited: malware, data scraping, or interference with Site operations.

8. Idea Submission

Unsolicited ideas grant us a royalty-free license to use them.

9. Termination of Use

We may suspend or terminate access at any time without liability.

10. Warranties and Liability

The Site and services are provided “as is” without warranties. We disclaim all implied warranties. We are not liable for indirect, consequential, or punitive damages. Liability is limited to $100 or amounts paid to us in the past 12 months.

All content, including project examples and costs, is illustrative and not a guarantee of results or pricing. We make no representations about accuracy or suitability for your needs.

11. Indemnification

You agree to indemnify us against claims arising from your use of the Site or breach of these Terms.

12. Miscellaneous

These Terms are governed by New Jersey law, with disputes resolved in New Jersey courts. If any provision is invalid, the rest remain enforceable.

13. User Accounts

If applicable, you must provide accurate information and keep credentials secure.

14. Prohibited Activities

No reverse engineering, hacking, or unauthorized access.

As noted, services may involve U.S. or international subcontractors. We ensure they meet standards but disclaim liability for their actions.

We reiterate: We are not licensed architects or engineers. Consult professionals for regulated services. In New York, interior design does not require licensure, but architecture does. Our use of “architects” in branding is conceptual and not indicative of licensed practice.
